  2. Which are the cost I should pay to buy a home in Casentino/Tuscany?

    Besides the atout fixed to buy the building you should add cost for the Notary, taxes to Italian Governement now it is 3% if you buy a first home or 4% of VAT if you buy from a builder. For second home tax is 11% or 10% of VAT if you buy from a builder. You should add also commission for the intermediation equal to 2 or 3%. There are other expenses if you subscribe a mortgage.


  3. Which are the procedure to follow to buy a first home in Tuscany?

    a)-Buying proposal
    b)-Preliminary contract
    c)-Final contract

    a) Buying proposal is the formal interest to buy at a reasonable price, if this proposal will be accepted from seller it is irrevocable.
    b) Preliminary contract it is a private contract that has got value in front of the law and should be registered and in this contract you can find the description of the building, price, way to pay, date of final contract and date on which the building will become property of the buyer.
    c) Final contract in Italy should be edit by a notary who is guaranteeing legality of the property transfer and relevant transcription on offices in duties. This final contract it is the only way to prove the property transfer.


  4. Is there any rule fixing the amount that should be paid as deposit?

    No, there is not any fixed rule but usually parties fix an amount.


  5. Is it necessary to sign a preliminary contract?

    No, you can directly sign the final contract from the buying proposal.


  6. After you signed a buying proposal and this one has been accepted or a preliminary contract can we withdraw?

    Yes, you can but you will loose any deposit or any amount already paid as advanced payment


  7. Can the Seller withdraw after signature of preliminary contract?

    Yes, paying to Buyer an amount that is double amount received as deposit and Buyer can also ask for damages and other expenses


  8. How many time it is needed to buy a building in Tuscany?

    From Buying proposal to final contract it can take 3/4 weeks if no bureaucratic difficulties.


  9. Is it a sure procedure the buying proposal?

    Yes, if all the procedures have been made by professional persons able and authorized to carry out fulfilment and checks needed (real estate agents, engineer, architect, notary etc.)


  10. Is it necessary the presence of the buyer at the final contract?

    Generally speaking yes. We can avoid if you can provide an official proxy to a third person.


  11. To have a property in Tuscany/Italy which are the taxes we should pay?

    There is a tax to be paid to the local common on the building that you pay basing on the fiscal value of the house (this value it is based on cadastral value, size, position, kind of house etc.) only if second house .Cadastral value should be added to personal income (IRPEF). For second house it is meant the house where you do not have the residency.


  12. To buy a home as first home what do I need?

    It needs that within 18 months from the final contract you have the residency in this home and you do not have any other property in all the Italian state.


  13. Is there any time limit to sell back the home I bought?

    In any moment. You have to take in account that if you sell in the first 5 years from the buying you should pay a tax on the amount coming out from the difference of the buying and the selling price. If first home you should also give the difference between the tax paid (3-4%) and the normal tax (10-11%)


  14. To whom I can address to verify if the real estate agent is a true professional person?

    You should always verify she/he is regularly registered to a Official registration called Albo Agenti from the province Chamber of commerce.


  15. How easy is it to build a swimming pool in the property that I am interested in?

    You will need planning permission from the local Commune. We will introduce you to a local expertise who can fullfill the necessary application for you.


  16. Should I use a solicitor from my home country?

    The Notary in Italy works for both the buyer and the seller and is responsible for the legal transfer of the property. Some clients prefer to use a solicitor from their home country for additional piece of mind - this is a personal choice.


Tax Code – Codice Fiscale
Assuming all goes well (and you don't want to loose your deposit), you will want to buy the house and sign the final contract (Rogito). But, before doing so you will need to have a tax code called Codice Fiscale in order for you to pay tax on the building. The Codice Fiscale works in much the same way as a National Insurance number and is easy to apply for.
